Privacy Policy
Your privacy is important to us. This Privacy Policy ("Policy") applies to services provided by Mediator Solutions LLC ("we", "us", or "the operator") and the Foundry website, product pages, and web application, or other digital products that reference this Policy (collectively, the "Services"), and explains what information we collect from users of our Services (a "user", "you", or "your"), including information that may be used to personally identify you ("Personal Information") and how we use it. We do not sell your data.
Scope and Applicability. This Policy applies to your information when you visit our website or otherwise use the Services. Where we process business records you enter on behalf of your own customers, you are the controller of that information and we act as a processor handling it under your instructions and this Policy.
What Information Do We Collect? Information You Provide to Us. To create an account or enable certain features we collect account information such as your name, email address, and authentication credentials. If you subscribe, our payment processor collects billing details; we do not store full card numbers or card security codes in our application database. Business Records. We store the clients, jobs, estimates, invoices, receipts, photos, and team records you choose to enter.
Information We Collect Automatically. When you use the Services we receive technical information: log data (IP address, browser type and settings, date and time of requests, and how you interacted with the Services) and usage data (features used and actions taken) needed to operate and secure the Services.
Information We Receive from Third Parties. If you sign in using a provider such as LINE, we receive the authentication information that provider supplies so you can log in. We also receive information from the service providers that help us operate, such as payment status from our payment processor and delivery status from our email provider.
- How We Use Information: to deliver and improve the Services; to secure accounts and deter fraudulent, unauthorized, or illegal activity; to process the transactions you request; to support customers; to meet legal, accounting, and tax obligations; and to contact you with essential service updates.
- Do We Share Personal Information: with service providers that support core operations — cloud hosting and database services (Amazon Web Services), payment processing (Stripe), transactional email (Resend), and sign-in (LINE) — each under its own terms; with the applicable business customer when we act on their behalf; and where required by law or to protect rights and safety. We do not share Personal Information for third-party advertising.
- Tracking Technologies: we use strictly necessary cookies and browser storage for sessions, security, language, market routing, and essential preferences. This deployment does not require behavioral advertising cookies.
- Security: we take reasonable steps to protect Personal Information against unauthorized access, alteration, disclosure, misuse, or destruction. Your account is protected by a one-time-code sign-in; keep your email account secure and sign out after use on shared devices.
- Data Retention: we retain Personal Information while your account exists or as needed to provide the Services, and afterward only for the security, accounting, dispute, and legal periods that apply, including de-identified or archived copies where permitted or required.
- Managing Your Privacy: you may request to review, update, correct, export, or delete the Personal Information in your account by contacting us. For your protection we may need to verify your identity, and we will respond in a reasonably timely manner.
- Children Under 16: the Services are not directed to individuals under sixteen (16) and we do not knowingly collect their Personal Information. If you believe we have, contact us and it will be deleted.
- Region-Specific Disclosures: California, EU/UK, and other residents have rights of access, correction, deletion, and portability under applicable law, and we do not sell Personal Information as defined by those laws. Users outside the United States acknowledge that information is processed in the United States and other locations where we or our providers operate.
- Do Not Track: we do not track visitors across third-party services for targeted advertising and do not alter behavior in response to Do Not Track signals.
- Contact Us: privacy questions and rights requests may be sent to the operator using the email on the Support page. Please do not send passwords, one-time codes, or full payment-card details.
Terms of Service
1. Definitions & 2. The Services. These Terms govern your use of Foundry, operated by Mediator Solutions LLC. "Services" means the Foundry web application and related sites. Subject to these Terms and an active subscription, we grant you a limited, non-exclusive, non-transferable right to access and use the Services for your lawful internal business operations. The Services, software, marks, and documentation remain owned by their respective rights holders. You may choose to connect third-party products (such as a sign-in provider); your use of those is governed by their terms.
3. Customer Data. As between the parties, you own the business records you enter ("Customer Data"). You grant us the limited right to host, process, and transmit Customer Data solely to provide and secure the Services. You authorize us to process Customer Data on your behalf and are responsible for having the rights and any consents needed for the information you enter. We may use aggregated and de-identified data to operate and improve the Services. We maintain reasonable administrative, technical, and physical safeguards for Customer Data.
4. Restrictions, Responsibilities and Rights. You must be legally able to enter this agreement and authorized to act for any business you register. You are responsible for accurate account information, safeguarding credentials, and the activity of the people you invite. You will not resell, disrupt, probe, or reverse engineer the Services beyond rights granted by law, bypass account or capacity controls, or use the Services for fraud, harassment, unlawful discrimination, deceptive messaging, or prohibited goods and services.
5. Fees; Payment Terms. The price, currency, billing period, included capacity, taxes, and any add-ons shown at checkout are the commercial terms for that purchase. Fees are billed through our payment processor and, unless stated otherwise, are exclusive of taxes for which you are responsible where law requires. Failed payments may result in retries, a grace period, or restricted paid features.
- 6. Warranties. Each party warrants it has the authority to enter these Terms. Except as expressly stated, the Services are provided "as is" and "as available" without warranties of any kind to the fullest extent permitted by law. Any beta or preview features are provided without warranty and may change or end.
- 7. Confidential Information. Each party will protect the other's non-public information disclosed in connection with the Services and use it only as needed to perform under these Terms.
- 8. Term and Termination. Subscriptions renew for the displayed period until canceled. You may cancel through the account or billing channel; cancellation stops the next renewal and service continues through the paid period. Either party may terminate for uncured material breach. On termination your right to use the Services ends and Customer Data is handled per the Privacy Policy and applicable retention periods.
- 9. Indemnity. Each party will defend and indemnify the other against third-party claims arising from its breach of these Terms or, for you, from Customer Data or use of the Services in violation of these Terms, subject to prompt notice and reasonable cooperation.
- 10. Limitation of Liability. To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, and each party's aggregate liability is limited to the fees paid for the Services in the twelve months before the claim. Nothing limits liability that cannot lawfully be limited.
- 11. General Provisions. The parties are independent contractors. These Terms are the entire agreement on their subject, are governed by the laws applicable to the operator's jurisdiction, and may be updated prospectively with notice when changes materially affect paid service. Rights that cannot lawfully be limited remain unaffected.
